Will my landlord increase my rent this year?
Your landlord can increase your rent in Dubai in 2023. However, the increase can only occur at the time of lease renewal and not during the agreed lease period. The Dubai Land Department requires landlords to provide a 90-day notice before the rent increase can take effect. If the landlord fails to give this notice, you have the legal right to refuse the rent increase, and your contract automatically renews at the same rental price.
There are also regulations in place that determine the maximum allowable rent increase based on the deviation from the average market rental rate.
Decree Number 43 establishes the maximum rent increase that landlords can impose in Dubai in 2023. The increase depends on how much the existing rent deviates from the average market rental rate. If the rent is less than 10% below the average, no rent increase is permitted. For rent between 11% and 20% below the average, a maximum increase of 5% is allowed, and the percentages increase in increments for rent deviations up to more than 40% below the average, where a maximum increase of 20% is permitted.
